SKS Inc Terms of Service Welcome to SKS! By using this site, including but not limited
to all web pages and SKS information resources within the sksoil.com domain, (hereinafter
referred to as “Website”) hosted by SKS Inc. (hereinafter referred to as “SKS”),
you (hereinafter referred to as “User”) accept the following SKS Inc. terms, conditions
and policies, including any future amendments (hereinafter referred to as “Terms”).
General: Non acceptance of Terms by User: If you do not accept and abide by the
Terms herein, you may not use the SKS Website. Terms and conditions may change at
anytime without notice at the sole discretion and authority of SKS. No use of the
site on your part will be cause to change the Terms herein.
Prevalence of State Law: The use of this Website shall be in accordance with the
laws of the State of California in the United States of America. User will abide
by the laws of the State of California regardless User’s local laws and/ or regulations.
Right of Revision: SKS reserves the exclusive right to make changes in Terms. Such
revisions will be posted at http://www.sksoil.com/Terms.aspx or can be obtained
by emailing customerservice@sksoil.com. Terms will not usually be sent to any User.
Users are bound by such revisions.
Rights and Licenses The Website and its total content is SKS Inc. Copyrighted Information.
The furnishing of information as provided on the Website shall not be construed
as establishing, either expressly or by implication, any grant of rights or licenses
to the User or any relationship between parties. No agreement or contract, beyond
the Scope of the Terms herein, including but not limited to Credit, Credit Approval,
Compliance agreements or any benefits is implied by the User using any SKS Website
and or complying with the Terms herein. User understands that nothing shall be deemed
to confer any third-party rights. Any expressly written and signed contracts and/or
agreements between SKS Customers and/ or Vendors stand independent of, the Terms
herein.
Privacy Policy: SKS will not share or distribute in anyway any information regarding
Users unless required by applicable law.
Website Access: User credentials are issued only by SKS and are for the sole use
of active customers. User’s passwords and accounts and account information are not
to be distributed or transferred to third parties in anyway. SKS reserves the right
to modify, suspend or discontinue the Website with or without notice at any time
and without any liability to User.
Website Information: SKS does not guarantee the, accuracy, or reliability of externally
linked information including but not limited to MSDS, compliance applications etc.
User acknowledges that any reliance on externally linked material will be at your
own risk.
SKS will make every attempt to provide current and complete data. Because of the
nature of real-time data, SKS reserves the right to verify posted data over any
given time period at its own discretion. The SKS process of data verification is
usually 24 hours not including weekends, holidays, emergencies and/ or qualifying
events. SKS may limit the kind and size of data to optimize performance and give
our customers in whole the best possible experience. User will not automate the
transfer information without written consent by SKS. User will not deploy any robot,
spider, other automated device, or manual process to monitor or copy any content
from the Website.
SKS takes no responsibility for third-party content linked from the Website to external
sites (including, without limitation, any viruses or other disabling features),
nor does SKS have any obligation to monitor such third-party content. SKS will not
be responsible or liable for the exercise or non-exercise of its rights under these
Terms.
User will not resell, reproduce, duplicate, copy, sell, trade, resell or exploit
for any purposes, any element, part or partial service or whole of the Website.
Indemnification. You agree to hold harmless and indemnify SKS, and its subsidiaries,
affiliates, officers, agents, and employees from and against any User and/or third-party
claim arising from or in any way related to User’s use of the Website, including
any liability or expense arising from all claims, losses, damages (actual and consequential),
suits, judgments, litigation costs and attorneys' fees, of every kind and nature.
